The head of the Ministry of Foreign Affairs Radosław Sikorski wrote in social media a “reminder” that “for illegal recording Falenta he had two years”. In this way he reacted to the words of MP Roman Giertych, who accused the use of PiS media with the use of recordings with his participation obtained by Pegasus.
“I remind you that for the previous illegal recording of Falenta he had two years. I hope that this time the media will not get excited with flavors, but will help identify criminals who recorded and disseminated conversations between the lawyer and the client” – wrote the head of Polish diplomacy. Giertych accuses the use of recordings from Pegasus
Giertych accused the media of the PiS media to use recordings obtained with the help of spy Pegasus software and link their publication with his application to recalculate votes in presidential elections.
Fragments of the conversation between Giertych and Tusk were published on Friday and Saturday, among others Television WPOLSCE24, stating that they concern shaping electoral lists in 2019 and negotiations of Giertych with Grzegorz Schetynathen the head of the Civic Platform regarding the possible start in the parliamentary elections.

“For two days, PiS media has been publishing fragments of my conversations recorded from June to September 2019 by the Israeli PEGASUS program as part of an illegal operation conducted against me by the CBA,” said Giertych. He also reminded that in this case there is an investigation conducted by team No. 3 of the National Prosecutor's Office, where he has the status of the victim. Prosecutors have been checking the unlawful use of this software in Poland since March 2024.
“These conversations according to the CBA statements were destroyed because they did not contain any content that had any criminal character. The fact of recording my conversation with Donald Tusk was already informed in 2022 in Wrocław 'Gazeta Wyborcza'.
“Recording of a lawyer's conversations with clients, lack of real destruction, bringing copies of conversations from the CBA, their transfer to the media and publishing these conversations are very serious crimes. They should be punished with all these crimes,” he added.

MP KO also assessed that the moment of publication of recordings is related to his request to recalculate votes in the presidential election and By decision of judges from the Supreme Court to recalculate votes in 13 committees. “Someone is very keen that this case would not be continued. It was decided to commit a number of crimes, expose the PiS media to losing the right of broadcasting, just to hit me” – he wrote.
Giertych also added that “at least fragments of the conversation with PDT (Prime Minister Donald Tusk – ed.) Are real because he remembers them.” “It should also be remembered, however, that Piotr Nisztor (journalist associated with TV Republika – editor's note), who will now get allegations once again, was once caught by the court on falsifying tapes” – he added.
President of the NRA: It's just an abuse of power
The president of the Supreme Bar Council Przemysław Rosati also referred to the matter, who assessed that the disclosed recording of Tusk's conversation with Giertych confirms that “Pegasus was used for surveillance without a legal basis, without related to the security of the state.”
What is Pegasus
Pegasus is a system that was created by the Israeli company NSO Group to fight terrorism and organized crime. With the help of Pegasus, you can overload conversations from an infected smartphone, as well as access to other data, emails, photos or video recordings as well as cameras and microphones stored in it.
According to information announced at the turn of 2021/2022, by the Citizen Lab group operating at the University of Toronto, Pegasus was under surveillance, among others Roman Giertych (currently MP KO), prosecutor Ewa Wrzosek and the then senator KO Krzysztof Brejza (currently MEP), as well as the leader of Agrounia Michał Kołodziejczak (currently deputy minister of agriculture). Pegasus's control was also included, for example, by the former president of Sopot, and currently MP Jacek Karnowski and one of the leaders of the Women's Strike Klementyna Suchanow. In recent months, there has also been information that prominent PiS politicians were also under surveillance.
The legality of the use of Pegasus in Poland raises serious doubts. In the Polish public debate, there was also controversy as to the funds from which it was purchased – they were to come from the Justice Fund, which was intended for help for crime victims.
The Sejm appointed the PEGASUS Investigation Commission, which examines the legality, correctness and purposefulness of activities undertaken using this software, including By the government, special services and the police from November 2015 to November 2023, the Commission is also to determine who was responsible for the purchase of Pegasus and similar tools for Polish authorities.
