The government adopted a draft amendment to the VAT Act

The Council of Ministers adopted a draft amendment to the Goods and Services Tax Act, the Prime Minister's office announced. The proposed act aims, among other things, to extend the validity of the so-called VAT reverse charge mechanism.

As announced by the Chancellery of the Prime Minister, during Tuesday's meeting a draft act amending the Act on Goods and Services Tax, the Act on Excise Duty and certain other acts submitted by the Minister of Finance was adopted.

“The new solutions are to enter into force on April 1, 2025, with the exception of the provisions regarding the VAT reverse charge mechanism, which will come into force on February 28, 2025,” the law firm said.

Assumptions of the project adopted by the government

The project includes, among others: extension of the application of the so-called VAT reverse charge mechanism (according to which the buyer, not the seller, is responsible for the settlement VAT). The solution will apply to gas, electricity and services related to the transfer of greenhouse gas emission allowances – until December 31, 2026. The proposed act aims to clarify and amend certain provisions in the area of ​​VAT rates (in the case of reduced rates under the tax on goods and services.

“Exemption from excise duty is being introduced for passenger cars that are professionally registered in Poland in order to perform test drives, in accordance with the provisions of road traffic law,” we read in the announcement. “These are cars that will be the subject of scientific research or test work as part of research and development activities,” it added.

The proposed act also introduces the institution of refund of excise tax on passenger cars temporarily registered in Poland for the purpose of exporting them from the country.

The project includes provisions abolishing the obligation to integrate online cash registers with payment terminals. In turn, reporting of data on payment transactions by settlement agents is maintained.
