I tried to convince them by saying that their legal speculations would not be understandable to the public, neither the government nor lawyers – said Ryszard Kalisz, a member of the National Electoral Commission, in “Kropka nad i” on TVN24, commenting on the decision of the National Electoral Commission to accept the financial report of Law i Justice. He emphasized that the second point of the committee's resolution means that the Minister of Finance should not pay money to this party.
The head of the National Electoral Commission, Sylwester Marciniak, announced on Monday that “the National Electoral Commission, implementing the decision of the Supreme Court, “adopted the financial report of the PiS committee from the 2023 parliamentary elections”. He said that four out of nine members of the National Electoral Commission voted for the adoption of such a resolution, three were against and two abstained.
In mid-December The Chamber of Extraordinary Control and Public Affairs of the Supreme Court, whose activities are questioned, among others, by European tribunals, recognized PiS's complaint about the earlier rejection of the report by the National Electoral Commission..
Kalisz pointed out that he had submitted a request not to consider on Monday the point regarding the adoption of the report of the Law and Justice Electoral Committee due to the current decision of the National Electoral Commission of December 16 to suspend the consideration until the legal situation of this chamber is settled in the Supreme Court. – Mr. Chairman did not put it to a vote at all – he said.
– We lost, I lost – added a member of the National Electoral Commission, referring to the decision to accept the PiS financial report. – I have always been against recognizing the judgments of the Chamber of Public Affairs and Extraordinary Control. I voted this way today too, he said.
“The Minister of Finance should not pay” PiS money
The host of the program, Monika Olejnik, asked Kalisz what was going on in the second paragraph of the resolution adopted by the National Electoral Commission.
– Please ask a question to the four people who voted (for – ed.) – said Kalisz. He explained that he “repeatedly discussed and repeatedly told the members of the National Electoral Commission that it would be incomprehensible.” – I tried to convince them, saying that I had excellent experience and their legal speculations would not be understood by the public, neither the government nor lawyers – he noted.
– If the second point of this resolution states that they do not decide whether this (Chamber of Extraordinary Control – ed.) is a court or not, then they do not say that it is a court. In other words, in my opinion, on the basis of this document, the Minister of Finance should not pay (PiS money – ed.) – he concluded.
