Cinkciarz.pl plans to transform into a joint-stock company. The documents necessary for this process are being prepared, the company said. It also announced that it would submit an application for a banking license in the European Union. On Tuesday, the Regional Prosecutor's Office in PoznaĆ published an “important announcement” for the victims in the case regarding the website.
“The decision to transform Cinkciarz.pl into a joint-stock company (SA) has already been made, and the documents necessary for this process are being prepared. (…) The transformation will allow us to strengthen financial stability and open new business opportunities,” the information said. . It was added that the change of legal form will be completed as soon as possible.
The trader wants to transform
It was reported that at the same time, the necessary documentation is being prepared for the company to obtain a banking license in the European Union, which will enable it to introduce a full range of banking services. “Obtaining a license is a key element of our strategy, which will provide you, our clients, with even greater financial security and access to advanced banking products,” it said.
The company assured that after obtaining a banking license, all its clients' funds will be protected by the Bank Guarantee Fund, “which will guarantee the highest level of security.” “This protection will be an additional guarantee for customers that their funds are fully secured,” it added.
The company asked users to “avoid submitting applications to the courts, as such actions may further impede our reorganization and delay the return to full operation. Our goal is to restore smooth service as soon as possible, but we need time to sort out all the formalities and implement new procedures.” – appealed the company. “We are aware of the difficulties you are facing due to currency exchange delays. We apologize and assure you that we are doing everything we can to rectify the situation,” she added.

“Due to the very large amount of correspondence received by the Regional Prosecutor's Office in PoznaĆ from injured parties in this case, the prosecutor's office informs that each letter sent is subject to a thorough analysis and is taken into account in the planned procedural activities. The large amount of correspondence makes it impossible to provide individual answers.” – the Regional Prosecutor's Office in PoznaĆ said in a message for victims in the case regarding the Cinkciarz portal.
She also added: “Procedural activities with the participation of injured persons will be carried out by Police officers who will successively contact the interested parties.”
Exchange office, banks, Polish Financial Supervision Authority
In October, Cinkciarz.pl and its subsidiaries (Conotoxia sp. z o. o. and Conotoxia Ltd.) announced lawsuits against the following banks: BPS, BOĆ, Credit Agricole, ING, Millenium, Getin Bank, mBank, Citibank and SGB. The currency exchange office argues that these banks denied him access to their currency platforms, which made it impossible to conclude currency exchange transactions with them, and accuses them of “bank collusion”.
At the turn of September and October, the Polish Financial Supervision Authority announced that it was taking action following customer complaints regarding the provision of currency exchange services by the Cinkciarz.pl currency exchange office. UOKiK also reported that it had received 13 customer complaints about the company. Users were affected by delays in currency exchange and money transfers. They were to be informed about the defect, which should be repaired by the end of October.
At the beginning of October, the Polish Financial Supervision Authority withdrew the authorization to provide payment services to Conotoxia, operating through the agents Cinkciarz.pl and Cinkciarz.pl Marketing. It was then explained that the consequences of the decision would include, among others: deletion of the company and its agents from the register of payment service providers. Cinkciarz.pl informed that it was taking legal steps to repeal the Commission's decision as soon as possible.
Cinkciarz.pl informs on its website that it is a company registered in Poland and provides online currency exchange services in three transaction models. It is a member of SWIFT (Society for Worldwide Interbank Financial Telecommunication).
