The owner of the plot will be able to cut a tree if, within 35 days of such a request, the relevant authority does not raise an objection – according to the assumptions of the project published in the list of government works.
According to the current provisions, the authority, to which the intention to remove the tree has been submitted (most often: the head of the village, mayor, city president), has 21 days to inspect, and in the time limit 14 days from the date of inspection, he may object. Therefore, the tree can be removed if the competent authority did not object within this period.

“Therefore, if the inspection was not carried out within 21 days, the deadline for raising an objection does not start running. This may cause that proceedings regarding the removal of a tree from the property owned by a natural person, which are removed for purposes not related to conducting economic activity, may excessively prolong” – indicated in the description of the designed changes.
Pursuant to the proposed provisions of the 35-day, the deadline for raising an objection would be counted from the date of notification.

According to the authors of the project, i.e. the climate and environment of the environment, this would protect the applicants against inactivity or lengthiness of the proceedings.

The government intends to adopt the planned regulations in the third quarter of 2025.
