Deputy Minister of Justice Maria Ejchart held several hours of consultations with the directors of District Educational Centers. The meeting is a consequence of the events in Jerzmanice-Zdrój in Lower Silesia. Two employees of the local center were charged with abusing pupils. The 13-year-old is still fighting for his life in the hospital. – These difficult moments affect all of us, but we must find solutions together that will allow us to draw conclusions from this situation – said the deputy minister.

The meeting of the Deputy Minister of Justice with the directors of District Educational Centers took place on Thursday, December 5. This is the result of an event that took place in the second half of November, when in the District Educational Center in Jerzmanice-Zdrój (Lower Silesia) one of the pupils he attempted suicide after being beaten by his teacher. The 13-year-old is fighting for his life in hospital and is currently in a medically induced coma.

I know how much the community is affected by this, and it is fully understandable. Conclusions and demands of directors

As the Ministry of Justice announced on Friday, during the discussion, consultation participants developed a preliminary list of proposals aimed at improving crisis management, raising safety standards and supporting students and staff of centers in difficult situations.

“Their implementation will allow for the creation of a systemic procedure and thoughtful response to extreme crises,” the ministry said.

The Ministry presented the developed conclusions and demands of the OOW directors.

ACTIONS AND CHANGES AT THE CENTER LEVEL • After a crisis occurs, it is necessary to urgently ensure the personal presence of the ministry's inspector at the facility. The inspector's task is to help on-site in crisis management and also act as a liaison with the ministry. • Imposing an obligation on the directors of facilities to establish a crisis team in the event of an extraordinary event of an exceptional nature. The staff will be composed of representatives of the facility and the ministry. • In the event of an extraordinary event of a special nature, information and support activities should also be undertaken with respect to other facilities, in accordance with the principles of crisis management. Staff and pupils cannot learn about the event from the media; it is necessary to provide such information to patients in a thoughtful way to limit the negative impact • If it is necessary to provide information to the media, directors of facilities should be provided with maximum support from the Ministry's Communication Office, as was the case in Jerzmanice-Zdrój. • Reducing the size of educational groups in district educational centers (currently, it is a maximum of 12 people in a group). • Profiling district educational centers, e.g. into rehabilitation and therapeutic centers. • It is necessary to solve the difficulties in placing charges requiring psychiatric treatment in medical facilities, resulting from the lack of available places. • Amends the regulations giving the director of the facility the right to obtain information about the health condition of a student during his or her treatment. • Obligation of directors of institutions to provide teaching staff with training and regular supervision. • Application to the National School of Judiciary and Public Prosecution to include study visits to facilities for minors in the training program for judges adjudicating in family cases (completed). The level of knowledge about the system among family judges should be increased. • Changing the regulations regarding granting leaves and passes to pupils placed in temporary facilities (currently, the consent of the court and the prosecutor's office is required). • Introduction of permanent training for security staff. • Introduction of a provision enabling a minor to be placed outside the district educational center for a specified period of time, following the example of Art. 274 of the Act on Support and Resocialization of Juveniles regarding juveniles from correctional facilities. • Establishment of hostels at OOW.

ACTIONS AND CHANGES AT THE SYSTEM LEVEL (INDIRECT) • District Educational Centers cannot be universal facilities for children with any problems; family judges refer minors who, due to their disabilities or dysfunctions, should stay in treatment facilities. Legislative postulate to be considered during work on amending the Act. • Changing the provisions of the “Teacher's Card” Act regarding the possibility of early retirement for teaching staff (currently 35 years of experience, the requirement is 25 years of experience). • Increasing the management staff by adding the position of deputy head of the dormitory. • The problem of aging teaching staff in institutions requiring a systemic response. • Inevitability of consequences – pupils often do not face legal consequences after attacking facility employees. • Familiarizing center directors with monitoring and documentation in the case of traumatic, critical emergency events in other facilities – in order to draw conclusions. • Solving the difficulties in drawing disciplinary and legal consequences against teaching staff who display inappropriate behavior towards minors. • Considering the creation of diagnostic centers within the structure of the facilities, which will enable quick diagnosis of minors and take appropriate actions. The proposed solution is provided for in the current regulations, the decision remains with the court. The matter requires deeper analysis. • Prolonged temporary stays of juveniles in educational centers – faster pace of court work is necessary. • The decision to place a juvenile in a group with increased supervision or a regular group in a shelter for minors should be made after diagnosis by the director. The court is currently deciding on this. • Fulfillment of the obligation of the President of the District Court to convene meetings with the participation of family judges and facility directors. • Exemption of diagnostic teams from working for graduates (adult pupils outside their school obligations).

The Ministry announced an assessment of the collected demands. He is to present his position during the next meeting with the directors of the centers.
