The trial of Marcin Z., a former policeman accused of a brutal murder of a 53-year-old plasterer, ended before the District Court in Warsaw. According to investigators, Z. was guilty of his victim for the service rendered.
On Tuesday at the District Court in Warsaw, the last hearing took place and judge Maciej Gruszczyński closed the court.
Previously accused Maciej Z. gave supplementary explanations. He stated in them that Marek D.'s death was an unfortunate accident. He pointed out that he paid the plasterer for his work, and he re -reported for money. On the day the crime occurred, a quarrel ended with a fight as a result of which Marek D. fell. – I realized that something was wrong. I checked his pulse and he wasn't there. He didn't breathe. Hands dropped limply – said Marcin Z. in court.
– I don't know why I did it later. I can't remember my reasoning – he explained in the courtroom. He added that there is no day that he would not think about it. – I destroyed my family's life, the second family. All the time I wonder how it happened – the accused added.
Prosecutor: Actions of the accused intentional and consistent
Then the parties gave final speech. Prosecutor Michał Magier emphasized that the collected evidence indicates that there was no payment for the work performed by Marek D., and the accused's actions were intentional and consistent. – This accused was an unreliable debtor, not Mr. Marek D. – noted the prosecutor.
In his opinion, however, the opinion of an expert in the field of forensic medicine is crucial in this case, which indicates that the cause of the man's death was decapitation. He also applied for imposing a life sentence to the accused and deprivation of public rights for 10 years.
– Undoubtedly, we are dealing with a special matter when it comes to murder, due to unprecedented brutality and due to the motivation of the perpetrator – said a representative of auxiliary prosecutors. He noted that no evidence confirms the thesis that Marek D. could attack the accused.
Defense claims that this is an unfortunate accident
On the other hand, the defender of the accused Paul Wierzbicka emphasized that Marcin Z. settled for the work performed with Marek D. in her opinion, the accused had injuries indicating that there was a fight. And the whole thing is an unfortunate accident that Marek Z. regrets.
She also pointed out that too short psychological examinations were carried out and there was no psychiatric observation. At the same time, she requested a change in the qualification of the act to a fight with a fatal effect and insulting the corpse, as well as a gentle punishment. She also indicated that the accused was acting in affect and did not remember the motives he was guided by.
– I'm sorry the victim's family for what I did (….). I can't explain it – said the accused at the end.
The verdict in this case is to be passed on May 14.
Crime at the construction site
The crime took place at the beginning of June last year. In the evening, 53-year-old Marek D. went to Warsaw for a meeting with a client who was supposed to be owed to him for plastering works. When officers arrived. Inside the unfinished house, they found a foil that covered the dismembered corpse of the 53-year-old. A 45 -year -old retired policeman was detained in the case – Marek Z. was dealt with by the District Prosecutor's Office in Wołomin. The man was arrested and accused of murder. According to investigators, he was supposed to kill because he wanted to avoid paying invoices.
