The inmate's death occurred at the end of August in a prison in Wrocław. When the prison services tried to overpower him, the man lost consciousness. The prosecutor's office obtained a preliminary autopsy report – a significant amount of drugs was found in the blood, but especially in the urine of Damian Ch., including: methamphetamine – says the spokeswoman of the District Prosecutor's Office in Wrocław.
A preliminary autopsy report was obtained of the deceased Damian Ch. and an opinion on toxicological tests.
“This opinion shows that a significant amount of narcotics, including methamphetamine, was found in the blood and, above all, in the urine of Damian Ch., which may somehow justify his behavior before the incident. It was established that the inmate Damian Ch. was aggressive, agitated, did not respond to commands to calm down, woke up at night, woke up a fellow inmate in the cell,” says Karolina Stocka-Mycek, spokeswoman for the District Prosecutor's Office in Wrocław.
The prosecutor's office is waiting for the full autopsy report. “The preliminary results did not give us any basis to determine the cause of death,” he explains.
Intervention
“Prison service officers had to overpower the man. During these activities, the inmate felt bad. An ambulance was called to the scene and took him to one of Wrocław's hospitals,” Stocka-Mycek said.
Damian Ch. he died in hospital, of which the prosecutor was immediately notified. In the proceedings for unintentional manslaughter, Mr. inspection of the scene of the incident and the prison cell. The deceased's mother, nurse, doctor, paramedics and a fellow inmate were interviewed. Monitoring has been secured.
The evidence currently available to the prosecutor's office does not indicate that the officers exceeded their powers. “I would like to emphasize that this investigation is still ongoing,” the spokesman adds.

“Measures of direct coercion were applied to the convict”
“In response to his unexpected attack on the officer, threatening his safety and health, direct coercive measures appropriate to the situation were applied to the convict, specified in the current provisions of law. During the incident, the inmate lost consciousness. The officers immediately took rescue measures, including resuscitation, which ended life functions were restored. The Emergency Medical Team was called. During transport to the medical facility, another cardiac arrest occurred, resulting in the death of the inmate,” informs us. According to Cyrulik, in accordance with applicable regulations, prison employees informed the prosecutor's office, the police, the district court and the penitentiary judge. The District Inspectorate of the Prison Service in Opole is also investigating the case.
“The materials collected so far do not indicate that the officers using direct coercive measures exceeded their powers. No one was suspended from performing their official duties. All materials, including those from monitoring and body-worn cameras, were handed over to the District Prosecutor's Office for Wrocław Psie Pole, which is conducting proceedings in the case” – explains the prison spokesman.
