Zbigniew Ziobro reported that he submitted a notification to the prosecutor's office of suspected crime in a relationship with – as he assessed – an illegal attempt to deprive him of freedom of up to 30 days. The parliamentary commission for Pegasus applied for arrest against a PiS MP.

Key facts:

  • The former Minister of Justice did not appear several times at the meeting of the Sejm Investigative Commission for Pegasus.
  • The Commission requested that the detention be applied for up to 30 days towards Zbigniew Ziobro to lead to his interrogation. The District Court in Warsaw did not accept this application.
  • Ziobro reported that he was a notification to the prosecutor's office regarding an attempt to deprive him of freedom by the Commission.

The parliamentary commission for Pegasus for the sixth time tried to question the former Minister of Justice on Thursday. At the end of January Zbigniew Ziobro With the consent of the court, he was detained by the police and brought to the Sejm, but ultimately he was not questioned, because the committee closed the meeting after the hour he was to appear at.

The Commission then, through the Prosecutor General Adam Bodnarsent a request to apply a detention of up to 30 days towards the former Minister of Justice to lead to his interrogation. On March 31, the District Court in Warsaw did not accept the application of the parliamentary commission.

Ziobro about notification to the prosecutor's office

On Friday, Ziobro informed at a press conference that he was directed to the prosecutor's office “about the suspicion of committing a crime in connection with the illegal attempt to insidious deprivation of his freedom for a month”. In Ziobra's opinion, the court found the commission's request unfounded.

– This is the first case since 1989, when officially on the court's forum it was possible to hear, see and read that the authorities attempted a manipulated and insidious deprivation of a MP based on the spokeen false documents that did not correspond to reality, which were a lie even in a collision with documents provided by the police and the marshal's guard, subject to the same power – Ziobro.

This, in his opinion, shows “the fierceness of Donald Tusk and his political community”, which “decided to attempt illegal, insidious arrest representatives of the largest opposition party”, or PIS.

In the opinion of Ziobra, these activities are also part of the events of the Thursday meeting of the parliamentary investigation commission to which he was called. When he did not appear, the Commission announced that he was submitting to the court a request for punishment. Ziobro later stated that the Commission “could not even effectively send a notification on time” – the call for the interrogation had a date of receipt until the end of the work office of the post office on Thursday.

In addition, Ziobro, refusing to appear on the commission, constantly cites the judgment of the Constitutional Tribunal of September last year, which ruled that the resolution of the Sejm on the establishment of this committee is unconstitutional. This judgment – like the others since March last year – was not published in the Journal of Laws.

The court did not grant the application for arrest for Ziobra

At the Thursday meeting, the chairwoman of the inquiry commission Magdalena Sroka said that “there was no doubt that Zbigniew Ziobro knew perfectly well that the date of interrogation was set for today.” She added that “such information reached him on April 7”.

The previous attempt to hear Ziobra took place on January 31. After he did not appear at the meeting several times, the Commission asked the court to stop the MP and bring him to the interrogation. The Sejm repealed his immunity for this purpose, and the District Court in Warsaw agreed to this. The police detained Ziobra on the day of the meeting of the investigation commission after 10.30, when he finished interviewing at the headquarters of Telewizja Republika. The start of the meeting of the investigation commission was scheduled for 10.30. Since Ziobra was not in the meeting until this hour, the investigation commission recognized the former minister as ineffective and decided to direct the application for a order of order to him up to 30 days of arrest.

March 31 The Warsaw District Court did not accept the application for the application of detention against Ziobra. Court spokeswoman judge Anna Ptaszek announced that “the commission withdrew from the possibility of interrogating the witness, despite the fact that he was brought to the committee.” Ziobro himself has repeatedly emphasized that he did not resist detention on January 31 and assessed that the investigation commission did not want to question him, since she closed the meeting when he was on his way.

The head of the investigation commission for Pegasus Magdalena Sroka reported on Friday on TVN24 that on June 5 another date of interrogation of Ziobra was set.

Commission for Pegasus

The Commission is investigating whether the use of Pegasus surveillance software by the government, special services and the police at a time when PiS ruled was lawful. The Commission is also to determine who was responsible for the purchase of Pegasus and similar tools for Polish authorities. According to the information provided so far, among others by the Supreme Audit Office, the PEGASUS System was purchased in the autumn of 2017 for CBAfrom funds from the main part (PLN 25 million) from the Justice Fund supervised by the Ministry of Justice.
