The parliamentary investigative committee for Pegasus will try to question Zbigniew Ziobro for the fourth time. The former Minister of Justice and Attorney General is expected to appear before the committee on November 4 at 10 a.m. So far, he has not sent a medical certificate, but he wrote on his social media that it is a “supposedly commission” and its members are committing a crime by calling him for questioning.
– There is no investigative commission for Pegasus, there are no members, it is one big lie – comments MichaÅ‚ Wójcik, an MP from Law and Justice. This is the only current PiS narrative about the parliamentary investigative committee for Pegasus.
The commission is here and working. On November 4, she again called Zbigniew Ziobro as a witness. – Mr. Zbigniew Ziobro is obliged to appear before the committee, and his ideas about relying on the Constitutional Tribunal and the ruling of Julia PrzyÅ‚Ä™bska's tribunal, which allows him to behave in this way, are absolutely unacceptable – says Magdalena Sroka, MP of the Third Way and chairwoman parliamentary investigative committee for Pegasus.
By November 3, Zbigniew Ziobro had not sent the committee any justification for his possible absence.
In social media, the summons to the investigative committee calls the card and its authors pranksters. The former minister, citing the decision of the Constitutional Tribunal, writes about criminal liability for MPs impersonating a non-existent committee.
Julia Przyłębska is the oracle of PiS
– There is no alternative today that he is sick, no one from PiS raises this argument anymore. Now Mrs. PrzyÅ‚Ä™bska is the most important oracle on this matter for PiS. We operate in accordance with the law, in accordance with the letter of the law. Within the legal provisions and procedures, Mr. Ziobro must testify – says Tomasz Trela, MP of the Left and member of the parliamentary committee for Pegasus.
Law and Justice MPs voted for the establishment of the investigative commission and took part in its work until Julia Przyłębska's tribunal found that the scope of the commission's activities was inconsistent with the constitution.
– These rulings are not valid. This has been clearly stated by Polish and international tribunals, Mr. Ziobro will have to appear before the committee – emphasizes Marcin Bosacki, MP of the Civic Coalition and member of the parliamentary investigative committee for Pegasus.
The fact that witnesses associated with Law and Justice stopped responding to the commission's summons makes its work much more difficult, especially since they are often people with extensive knowledge, such as the former head of the Internal Security Agency Piotr Pogonowski, former head of the CBA Ernest Bejda or Zbigniew Ziobro.
“The evidence is very damning”
– We have evidence of Zbigniew Ziobro's participation in the entire procedure of purchase and use, illegal use, of Pegasus itself, which makes the evidence very incriminating against Zbigniew Ziobro – says Witold ZembaczyÅ„ski, MP of the Civic Coalition and member of the parliamentary investigative committee for Pegasus.
So far, the committee has only submitted a request to the court in relation to Piotr Pogonowski, but the members do not rule out that they will do the same in relation to other witnesses who did not appear.
– The actions of these people who call themselves members of the commission are criminal activities, because there is no commission, so such an investigation would not fit any standard or regulation at all, because they have no right to do so – says MichaÅ‚ Wójcik .
In the case of Zbigniew Ziobro, who is an MP, the procedure for bringing him to court does not only involve an application to the court.
– We must abolish his immunity, i.e. the Sejm must vote that he may be detained and brought by the police to our committee. I will request that we do it tomorrow, announces Marcin Bosacki.
There is one more possibility. Witnesses, at the request of the commission, may be questioned by the prosecutor's office. – Zbigniew Ziobro will not avoid this responsibility, both before the prosecutor's office and the court – says Magdalena Sroka.
