Three men and two women met over alcohol. They were joined by a 73-year-old man they didn't know much. Men didn't like how the guy treated women. They beat him, kicked him, one of the attackers used a board with nails. A 73-year-old man is dead, five partygoers have been charged.
On Tuesday after 5 p.m., a resident of Zawiercie called 112, reporting that “my friend is probably dead.” According to the report, the man drank too much alcohol, fell and was lying down. An ambulance arrived at the scene first. The doctor confirmed the death of a 73-year-old man from the Kroczyce commune. And he found traces of beating on his body.
There were five people in the apartment, two women aged 31 and 40 and three men aged 26, 42 and 44. Everyone's drunk. Until the case was resolved, they were detained and taken to police custody.
Blows with a board with protruding nails
The police began to determine what exactly happened in the apartment.
“The information provided by the party participants showed that a 73-year-old man, whom the others did not know very well, came to the apartment with alcohol. And already then they noticed that he was beaten. After a few drinks, he fell on the floor and from there “he stood up,” describes the Zawiercie police.
However, investigators questioned the detainees' account. “As investigators found, the 42-year-old and his friend, two years older than him, did not like the behavior of the unknown guest towards two party participants. They attacked the man, beating him on the head and kicking him. According to the findings, the 44-year-old also hit by a board with protruding nails. A resident of the Kroczyce commune did not survive the brutal attack. The man was lying on the floor for some time when one of the women finally called the emergency number 112, stating that my friend was probably dead.
Charges of assault causing death and failure to provide assistance
On Thursday, everyone was charged. The women and the youngest man will be held accountable for failing to provide help, which is punishable by up to three years in prison. All three were placed under police surveillance.
A 44-year-old resident of Zawiercie will be charged with fatal assault with the use of a dangerous weapon. The 42-year-old was also charged with assault causing death. It also turned out that both men would be held accountable as recidivists.
On Friday, the court in Zawiercie, at the request of the prosecutor's office, imposed temporary arrest on the 44-year-old and the 42-year-old for three months. They face many years in prison.
The Penal Code states that if a fight or beating results in the death of a person, the perpetrator is punishable by up to 15 years in prison. However, for participating in a fight or beating up a person with the use of a firearm, knife or other dangerous object, the perpetrator may be imprisoned for eight years.
