The duty of the National Electoral Commission is to thoroughly examine the report of the election committee. The National Electoral Commission itself determined before the parliamentary elections what is and what is not a violation of the Electoral Code – said Jan Grabiec, head of the Prime Minister's Chancellery, in “Fakty po Faktach” on TVN24. He added that the letter from the Chancellery of the Prime Minister to the members of the National Electoral Commission has “exactly this arrangement”. – The National Electoral Commission's guidelines, legal regulations and dozens of examples of violations of this formulation – he said.

Until July 31st National Electoral Commission is to decide on the settlement of committees from last year's parliamentary campaign. The National Electoral Commission has asked the Prime Minister to provide data on notifications sent to the prosecutor's office after audits of public institutions. This concerns matters that may result in the rejection of the financial report of an election committee. The Chancellery of the Prime Minister confirmed that it has already sent a response to the National Electoral Commission.

The case was first described by the Money.pl portal. It pointed out that “the most questions are raised by the decision regarding the report of the Law and Justice committee, whose candidates were supposed to have been supported by money from the Justice Fund (specifically Ziobro's supporters) or used state functions or resources to conduct campaign activities (e.g. 800 plus picnics)”.

Grabiec: the material contains facts, names

Head of the Chancellery of the Prime Minister Jan Grabiec referring to the case in “Fakty po Faktach” he said that “according to the materials we have collected, the PiS election campaign was financed with millions of zlotys from the state budget and state organizational units”.

He added that “this is contrary to the electoral code”. – What is more, decisions to spend these public funds on the election campaign of candidates PIS or the entire committee, because sometimes these were collective events, such as those 500+ (800+ – ed.) picnics, hosted by PiS functionaries – said Grabiec.

– I would like the members of the State Electoral Commission to devote some time, because this material is, yes, extensive, but it contains facts, names, dates, places, and is also documented photographically (analyzed – ed.) – he said.

“There is evidence, there are witness statements”

The host of the program, Piotr Kraśko, noted that Poles hear about millions of zlotys spent on various family picnics, 800+ picnics, millions from the Justice Fund, and asked whether it was spent so cleverly that it is untraceable for the National Electoral Commission, whether, in his opinion, the National Electoral Commission would not have fulfilled its duties if it had accepted this report and not accepted the information in its possession.

The head of the Prime Minister's office said that it is the duty of the State Electoral Commission to thoroughly examine the report of the election committee. In response to the fact that the report does not contain information about the Justice Fund, for example, Grabiec said that “there is none, but we witnessed this campaign, there is evidence of that”. – I will say more, there are testimonies of witnesses, those who participated in this campaign. The prosecutor's office has these testimonies – he said.

When asked whether members are obliged to analyse the Justice Fund’s expenditures or not, Grabiec said that “the simplest answer to this question is provided by the guidelines of the National Electoral Commission, issued before the last parliamentary election campaign, when the National Electoral Commission itself specified in a document it adopted what is and what is not a violation of the Electoral Code.”

– And our letter to the members of the National Electoral Commission has exactly this arrangement. The National Electoral Commission's guideline, legal regulations and dozens of examples of violations of this formulation. Another guideline, another legal regulation and a violation. All of this is documented – he said.
