Lidzbark Warmiński. The deputy director grabbed the 14-year-old by his neck and led the stairs. The case is examined by the prosecutor's office

The prosecutor's office initiated an investigation that will answer the question whether the deputy director of the Youth Educational Center in Lidzbark Warmiński exceeded his rights against a 14-year-old pupil. As the director of the center informs us, the boy – despite the requests – he did not want to go down the stairs, so the deputy director applied the overpowering grip against him.

Radio Olsztyn wrote about the case on her website. The article shows that the prosecutor's office initiated an investigation into exceeding his rights by the Deputy Director of the Youth Educational Center in Lidzbark Warmiński, which was to apply to one of the pupils the capturing grip over the neck and bring him half heels down. The police intervened on the spot.

– On April 16, one of the deputy director of the center informed us that the pupil is aggressive. After listening to the accounts of both parties, we informed about their rights. None of the parties at that moment did not submit a notification of the possibility of committing a crime, nor did the police report the need to provide medical assistance – says in an interview with tvn24.pl, young asp. Police: The deputy director was to cause damage to health

He adds that the next day, one of the tutors of this center, however, informed the police about the suspected crime by the deputy director.

– He was to cause damage to the health of a 14-year-old pupil. Policemen secured all evidence they gave to the prosecutor's office. This initiated the investigation – says the policewoman.

The District Prosecutor in Lidzbark Warmiński Andrzej Krzywiel informs that the investigation is conducted in the matter of exceeding the rights by the deputy director. And this exceeding would consist in causing a minor pupil injuries resulting in a light or medium damage to health. Pursuant to Article 157, the paragraph 1 of the Penal Code threatens from three to five years imprisonment.

According to the director of the center, everything was lawful

The director of the center Jacek Krzywdziński comments, in an interview with tvn24.pl, that everything took place in accordance with the procedures.

– The pupil stood in the staircase and did not want to join the group to go down to the living quarters. Despite the long conversation and requests, he insisted that he would not go down. Therefore, my deputy used a direct compulsory in the form of using physical force, which is permissible in the Act on support and resocialisation of minors. He had to do it, because if the boy continued to stand on the cage, it would disorganized the work of others – he points out.

He adds that the deputy director made a note from the use of a means of direct coercion, in which he wrote that he had applied to the boy a capturing grip over the neck.

– The regulations require that such a note be transferred to the relevant authorities, i.e. to a family court, which supervises the work of our educational institution and to the court competent for the place of residence of the pupil. This also happened – says the director.

Director: He had light redness around his neck

He emphasizes that the deputy director began, holding the boy by the neck, go down with him.

– After passing such a few stairs, the pupil was still based. So my deputy called the police. When she arrived, the boy calmed down and eventually went himself where he was to go – emphasizes the director.

He suspects that the person who informed the police about the possibility of committing a crime the next day is one of the tutors who witnessed this event and who has recently been working in the center.

– I have been working for 35 years and I have already seen more than one. The police got monitoring from the event. The fact is that when the uniforms appeared with us the next day, the boy had slight redness around his neck. However, it is not sure if they were associated with this event. Between one arrival of the police and the other, the boys were in the yard, sunbathing, went on fish. Reds could arise in completely different circumstances. This will be explained by the prosecutor's office – emphasizes Krzywdziński.

The boy has been in the center since 2021

He informs that 70 boys aged 10 to 18 are currently studying and currently studied in the educational center.

– They are teenagers with a light intellectual disabilities and boys who cause problems in schools – including They do not fulfill the school's obligation and do not follow the social rules. The boy he is about is in a group of difficult young people. He has been with us since 2021. Although he is young, his briefcase is one of the thickest. He is very smart, knows perfectly well the rules that apply in the facility and knows that he should then go down the stairs – emphasizes the director.

The school board suspects that it could have fed up with the law

According to Jolanta Skrzypczyńska, the Warmian-Masurian School Superintendent, there is a great suspicion that it could have fed up with breaking the law.

In an interview with Radio Lublin, she admitted that working in such a center is difficult and can go nerves, but the behavior of the deputy director – if confirmed – is unacceptable.

She also stated that the situation in the facility has been concerned for a long time, because since she became a curator, she got further signals about subsequent irregularities. They know from them that young people do not want to be there, and some are even afraid.

The eldership appointed a team

Poviat eldership is also interested in the matter.

– The staroste's order was appointed a team that is to examine what the situation is in the center. The point is for young people to feel safe in this institution – he says, a conversation with tvn24.pl, deputy staroste Jarosław Kogut.

According to Radio Olsztyn, whether there is irregularities in the institution is also examined by the Ministry of National Education.

The center was loud in connection with the death of a 14-year-old

Two years ago, the Educational Center in Lidzbark Warmiński was loud in connection with the death of a 14-year-old who was found with a broken head on the sidewalk in front of the building. He was hospitalized, where he died.

The account of the director of the facility showed that the boy was running away with other pupils through a small window in the toilet.

– After careful analysis of the evidence, the case was legally discontinued. The investigation concerned the unintentional causal of death and the educator failure to fulfill his duties. However, it was not found that the law was broken, which – after filing the prosecutor's decision – upheld the court. It was an unfortunate accident – Daniel Brodowski, spokesman for the District Prosecutor's Office in Olsztyn, tells us.
