Opole. Maja was a step away from death, the second dog did not live to help. Owners guilty, but without punishment

Black – that's what Maja was called. Once, the name of the bitch had to fit her jet black fur, but when activists for animal rights came for her, she was almost bald. Individual tufts of hair gave way to scabs and tight armor of hardened skin. The tip of the head meant a bleeding wound, scratched by black in a desperate attempt to fight the invasion of parasites.

The owners of Black did almost nothing to help her.

It was November 2022. The ordeal of an animal in one of the towns in the Brest poviat in the Opole region lasted for at least a few months. Two weeks before the intervention, a second female dog, FIFA, died, living in the same chilled room. She was probably also sick – skinny and infected with parasites. It was too late to determine the cause of death.

The disease developed at Czarna for at least three months. At that time, her owners – teacher Anna and entrepreneur Artur, marriage – did not buy medicine, did not take to the vet. They only bought a dietary supplement for hair falling out. He didn't help.

– When we arrived after receiving the notification, the black one was bloody in the barn of the owners. She was afraid to leave. She lived in a utility room, where there were no beds, only coal and droppings. There were a bucket with moldy food in the pen.

The recordings made available to us by Kadłuck show that the fucked female dog non -stop gently brushes and scratch wherever he reaches with his paws. He only interrupts to eat food.

The case went to court, and the marriage was accused by the prosecutor's office of abusing Maja. During the trial, it turned out that both bitches were last examined by the vet in 2015. Since then, even compulsory vaccinations have not undergone.

Anna and Artur S. did not fully confess to the end and negated the fact that they contributed to the deplorable state of the animal by their neglect. The defender of the accused even described both bitches, one of whom died, as “backyard dogs”, which – in the Court's opinion – was to suggest that the standard of care for mongrels living outside the home is lower than in the case of dogs that live with the household. He also claimed that the health of both dogs was consulted with a veterinarian – which, however, the court overthrew.

All these circumstances were enough for an unlawful sentence to a fine to a fine in the District Court in Nysa. He did not satisfy anyone – the prosecutor appealed to the higher instance, activists as prosecutors of meal and defender of the accused.

The District Court in Opole decided to give marriage a second chance, conditionally discontinuing the proceedings. This means that in addition to paying a relationship – quite high, because 10,000 zlotys from each – state S. avoided any penalty. They are formally still unpunished people – this will not change if they do not commit any crime for the next year. What's more, they now have a different dog, York, because the court has not ruled the ban on having animals. Although he could.

– The court had no doubt that the dog had abused, but for unknown reasons he decided that the accused would look after the next animal. Jędroś emphasized that also because of the misunderstanding of their mistakes by the accused, the sentence without punishment is “shocking”.

Why did the court decide to give a marriage from the Opole region a second chance? A press spokesman for the District Court in Opole, judge Daniel Kliś, to the questions of tvn24.pl answered that any punishment of the accused would constitute “too far -reaching criminal repression”.

“The fact that the accused have denied their perpetration has no particular formal significance (…). The court may, despite the failure to pay for the accused, to decide on conditional discontinuation, if it assesses that the circumstances of committing the act are beyond doubt, and such a situation – in the opinion of the adjudicating court – took place in the case under consideration. According to the District Court, the accused were not punished before, and Their degree of guilt and the degree of social harmfulness of the act assigned to them are not significant” – we read in the response of the spokesman of the Opole court.

Judge Kliś also informed us that “the personal conditions and properties of the accused and their current way of life justify the supposition that despite conditional discontinuation of proceedings they will comply with the law, and in particular they will not commit a crime.” In this context, the court also took into account the profession of accused Anna S., who is a teacher.

For Anna S., no criminal record is particularly important. Although the court found her blame, the conditional discontinuation of the proceedings means that a woman can still work at school. If the court punished her even with a fine, she would lose her job. We asked the headmistress of the school where S. works, or a person found guilty of abuse of an animal should teach children. She did not want to talk to us or contact us with a teacher who, last year – when after a conviction of the court of first instance threatened her end of her pedagogical career – she was awarded by the commune authorities for special achievements. We also tried to talk to Artur S., but the man did not want to comment on the case.

What about the ban on having animals? As judge Daniel Kliś explained, the court did not apply such a means because he decided “that the accused properly looked after another dog, also in the course of these proceedings.”

Dr. Robert Maślak, a zoologist from the University of Wrocław and a member of the State Council of Nature Conservation, believes that the conditional discontinuation of proceedings by the court is “outrageous”.

– This animal was treated as a thing. If it were a child, the court would be more severe. This judgment is completely incomprehensible to me. Contrary to what the court claims, we are dealing with great social harmfulness of the act, committed in addition by educated and resourceful people, including by a teacher who should be a certain model – commented Dr. Maślak.

Activists from the Lex Nova Foundation announce that the application to the Prosecutor General to consider the cassation of the judgment of the Opole court. – I do not know why the owners did not help the suffering dog, even when the second dog, also sick, died – said Izabela Kadłucka.

As the spokeswoman of the Prosecutor General, prosecutor Anna Adamiak, informed us, after the application is received by the Department of Court proceedings. “The case will be monitored and in the situation of registration of the impact of the application, appropriate actions will be taken,” Adamiak announced.

In addition to reconsideration of the case of the female mai, activists would like the court to deal with Fifa's death again. – In the testimonies that S. made as witnesses, they did not deny that the second female dog was also sick. Also in her case, the accused abandoned any medical assistance. However, the courts of both instances decided that there was not enough evidence to pull them responsible for her death – explained Jędroś. Prosecutor's allegations concerned both dogs.

Two years after cutting the dog drama, Maja looks like a completely different animal. The place of wounds was taken by shiny coat, the loving home replaced the fear of the outside world. She came to Monika and Grzegorz Sucza three days after the intervention. She weighed 10 kilograms then. Now he weighs 22.

– His recovery was very painful for her. Initially, she reacted with a squeal even to a stream of water. Drugs, shampoos, all this caused her pain – emphasized Izabela Kadłucka.

– I remember the first shower. Maja was very afraid, she complained in pain. She did not want to leave the house for a long time, fearing that she would stay outside. We had to take her to do her things. Even outside, she crumbled and walked along the house by the wall. We dressed her in clothes, because without fur all winter she had no protection against cold. She threw herself at food, she was hungry. She has broken teeth – Mrs. Monika, a new babysitter, told us.

Not only skin changes had to be treated, but also a number of other ailments: Maja has a sick thyroid, removed spleen, two milk strips, damaged heart and kidneys, he has a diagnosed cancer. – Despite various ailments and long -term treatment, he is now in excellent condition.
