Poznań. Drag Queen cut the throat puppets with a photo of the archbishop. There is another judgment

The Poznań District Court acquitted Marek M., who as Drag Queen Mariolkaa Rebell during the performance cut the throat of an inflatable doll with a photo of Archbishop. Marek Jędraszewski. It was his response to the priest's words about “rainbow plague”.

On Thursday, the District Court in Poznań upheld the judgment of the Court of first instance acquitting Marek M. From the allegation of insulting Archbishop Jędraszewski. The decision is final. The court stated that the accused's behavior did not fulfill the signs of calling to the murder of Archbishop. Jędraszewski did not insult him.

This is once again when the Poznań court dealt with this matter.

Marek M.'s first trial began before the Poznań court in 2021. The accused did not plead guilty. Marek M. argued that his performance during a closed event did not serve to persuade the murder, but “was to emphasize the problem” related to the earlier, aimed at the community LGBT a statement of a hierarchy about the “rainbow plague” threat.

In June 2022, the Poznań District Court acquitted Marek M. The prosecutor's office appealed in this case, and after another acquittal judgment – cassation to the Supreme Court. In 2023, the Supreme Court partly took into account the cassation, set aside the judgment of the District Court in Poznań and referred the case to that court for re -examination. In turn, the Poznań District Court set aside the judgment under appeal and referred the case to the Poznań District Court for re -examination.

At the end of September 2024, a re-trial in this matter began in the Poznań-Stare District Court. The court excluded the openness of the proceedings, because-as judge Monika Smaga-Leśniewska argued-in 2023 the higher court found that the acts of the accused could exhaust the features of the insult of Archbishop. Jędraszewski, not calling to kill him. Thus, according to the Code of Criminal Procedure, the trial in this matter was secret.

In October 2024, the court acquitted the accused Marek M. justifying the judgment judge Smaga-Leśniewska noted that the accused's behavior did not fulfill the features of the call to the murder of Archbishop. Jędraszewski did not insult him. From this unlawful ruling, the appeal – which was now dealt with by the District Court in Poznań – the prosecutor's office managed, demanding that the judgment be set aside and the case was referred to the Court of first instance for re -examination.

“Not red but rainbow”

Marek M.'s behavior during the performance was a response to the priest's words about “rainbow plague”.

On August 1, 2019, on the 75th anniversary of the outbreak of the Warsaw Uprising, during the homily in the St. Mary's Basilica in Krakow, Archbishop Marek Jędraszewski said that Free Poland was born from the insurgent graves. “It was necessary to wait a long time for her (…) The red plague is no longer walking on our land, but a new, neomarksist, wanting to master our souls, hearts and minds appeared. Not red, but rainbow ” – he said.

In August 2019, during the MR Gay Poland election in Poznań, Marek M. as Drag Queen Mariolkaa Rebell appeared with an inflatable doll, which had a photo of Archbishop. Marek Jędraszewski. The prosecutor's office's findings showed that with the words of the song played “… I killed him”, the man simulated the undercut of the clergyman with a knife, and to intensify the effect he was to use artificial blood.

The capital prosecutor's office accused Marek M. of public calling for the murder of a clergy, insulting the archbishop of the Roman Catholic Church and other people of this religion, and to call hatred against the background of religious differences. The acts accused of man are punishable by up to three years imprisonment. The man's trial started before the Poznań court in 2021.

Marek M. during the trial claimed that during the performance he symbolically “pierced” his own heart and then artificial blood appeared. This was to symbolize the pain the words of the Archbishop gave the accused Marek Jędraszewski about “rainbow plague”.
