President Puławy Paweł Maj was to hit the bars for five days for the city not paying a fine by the city. It was about noise on the school pitch. However, the penalty was paid – it is not known by whom. During the conference before the arrest, he supported the changes in the law announced by the minister of sport.

May pointed out that from 2018 he appealed to various institutions regarding the pitch, which turned out to be a bone of disagreement. His appeals were mostly unanswered – until now.

– It is shocking that it was only possible after such an act, after showing that you have to go to prison so that children could practice. It happened thanks to the residents, thanks to the people who supported me. I had some resistance and fears how I could go to prison, but they supported me – said the president in front of the detention center in Opole Lublin.

The president announced that changes in the law regarding the use of the eagles were announced. – Our goal has been achieved, changes are announced. (…) We hope that eagles in Poland will be open, that children will be able to practice – he said.

The changes were announced by the minister of sport

Minister of Sport and Tourism Sławomir Nitras On Thursday in the Sejm he reported that the ministry was preparing changes in regulations in cooperation with the Ministry of the Climate and Environment.

– We have prepared a legal solution. We are already advanced in this project. We will change the law within a month (…). Never again Orlik, no sports facility will be closed. And in Puławy we will lead to the opening of this facility, and President Puławy I am asking for cooperation, because this problem can be solved – assured the minister of sport.

President Puławy recalled these declarations in his Friday post. “Return to normality would be one of the greatest successes in my life,” he wrote. “We want to be sure that the announced changes will not end with the payment of a fine by the mysterious 'benefactor' – he noted.

Arrest for the president

President Puławy (Lubelskie Voivodeship) was to appear on Monday to serve a prison sentence in the Penitentiary Institution in Opole Lubelskie.

“I just received information that someone – without the consent and knowledge of the City Hall – was a fine, which led to the cancellation of my arrest warrant” – wrote May on his Facebook profile on Friday.

This information was confirmed on the same evening by the legal advisor of the City Hall in Puławy Ernest Stolar. – We got information from the court and from the bailiff that the order to set the president in detention was repealed, and the reason for this revocation was to pay a fine. We do not know by whom or exactly at what date – he said.

Stolar explained that in this case the payment of a fine by another person is not an offense, because the fine was ordered in civil proceedings. In addition, it was imposed on the city hall, not the president. – How this payment has come to court, we do not know. We had an individual sub -account in the request for payment, it was not an account indicated on the court's website – he noted.

May in his post emphasized that he disagrees “with such interference in judgments”, but he counts that this person or entity will soon reveal himself “and will also be happy to pay the fine to other victims of a defective system.” “Is the goal to avoid the compromise of the state and the judiciary?” – President Puławy asked.

The marriage complained about the noise

The matter of using the Orlik at Primary School No. 4 in Puławy dates back to 2018, when the marriage living nearby filed a complaint about noise and excessive lighting from the pitch. The court then banned the use of Orlik to people who are not school students, including adults and sports clubs. After building acoustic screens in 2022 for PLN 250,000, the town hall decided to share the pitch to everyone willing.

However, the marriage again reported the case to the court, applying for a fine of PLN 15,000. The District Court in Puławy dismissed the application, but the couple appealed against this decision. In December 2023, the District Court in Lublin changed this decision, considering that a final judgment of 2018 should be observed.

– For violation of the ban, he imposed a fine on the municipality in the amount of five thousand zlotys, with a change in the event of not paying detention for five days against the person authorized to represent the debtor, i.e. the Mayor of Puławy – said Judge's civil spokesman in Lublin. Judge Andrzej Mikołajewski.

To enable the use of an eagle to everyone willing, the municipality must prove in separate court proceedings that the installed screens effectively limit the noise from the pitch. – The point is to formally deprive the enforceability of 2018, which prohibits the use of the field to other people. The court case has been going on since November 2022 and is still taking place at first instance. Nevertheless, an appeal will also be entitled to this judgment, which is why it will last a bit – noted Stolar.

President Puławy declared from the beginning that the town hall does not intend to pay five thousand zlotys a fine. In this situation, the penalty was changed to five days of custody for the person representing the city, i.e. President Puławy. The deadline was agreed with the bailiff for April 7 this year.

May wanted his “symbolic imprisonment” to open the eyes of decision -makers – MPs, ministers – and mobilized to change the law. – Virtually every town, the municipality is exposed to the fact that someone will give noise from the field to court, and children outside the lessons will not be allowed into this area – he pointed out.

According to him, paying a fine by the municipality would be a acceptance for such a practice, and children should have the right to sport and rest without obstacles.

A spokesman for the District Court in Lublin for civil affairs judge Andrzej Mikołajewski explained that President Puławy is not formally convicted or punished. A substitute detention in this case is an enforcement agent in civil proceedings. This means that the finished fine is the fine, i.e. the Puławy commune, and it is formally to pay this amount, and the president is only a person representing the debtor. – This ruling and stay in custody has no influence on the rights related to, for example, starting in elections or any public activity – the spokesman specified.

In connection with the final court decision, the use of Orlik was limited. Students during school hours can currently use the field at school. So far, there were no further complaints from the neighbors.

48-year-old Paweł Maj has been the president of Puławy since 2018, when he won in the second round with the city's long-term authorities Janusz Groblem, winning 55.96 percent. support. Last year, he successfully applied for re -election from his own committee. He won in the second round of elections (68.04 percent), beating the Law and Justice candidate Mariusz Wicik.
