Prosecutor General Adam Bodnar and National Prosecutor Dariusz Korneluk presented nominations for assessor positions, first prosecutor positions, higher service positions and decisions on reinstating prosecutors demoted in 2016 to their service positions – the National Prosecutor’s Office informed.

As reported on the PK website, during Friday's event in Warsaw, nomination decrees were presented to 121 people. “Today, Prosecutor General Adam Bodnar and National Prosecutor Dariusz Korneluk presented nominations for assessor positions, first prosecutor positions, higher official positions, as well as decisions on reinstating prosecutors demoted in 2016 to their official positions,” we read in a statement published on the National Prosecutor's Office website. Since March 2016, the Prosecutor General has been Zbigniew Ziobro.

“Adam Bodnar assured that he will strive to ensure that the work of prosecutors is well-organized and satisfactory, and that he supports and will support the prosecutor's office so that it is independent of any pressures and fully implements its statutory tasks,” the PK announced in a statement on Friday.

As indicated, the Prosecutor General “emphasized the service role towards society in prosecuting crimes and upholding the rule of law”. He also noted that the perception of the prosecutor's office in society depends on professionalism, reliability and determination in carrying out these tasks.

Bodnar – quoted in the announcement – addressing assessors and prosecutors who received their first nominations, emphasized that “the independence of a prosecutor is not only not giving in to external pressure, but also responsibility for the level and effects of work”. He referred – as reported – to the draft law on the separation of the office of the Minister of Justice and the Prosecutor General, indicating the need to regulate the constitutional position of the prosecutor's office in the constitution.

Separation of the prosecutor's office from the executive power

The bill separating the functions of the Minister of Justice and the Prosecutor General was entered into the list of legislative works of the government. In mid-July, the Ministry of Justice announced that the Council of Ministers is expected to adopt it this year.

As the Ministry of Justice emphasized at the time, “the independence of the prosecutor's office from the executive power will serve to ensure effective control over potential violations of the law by those in power”. “Without independence, the prosecutor's office can be used to achieve political goals. Therefore, the separation of the functions of the Minister of Justice and the Prosecutor General should be implemented consistently and ensure real independence”, the ministry emphasized.
