One of the auditors, prosecutor Jarosław Onyszczuk, spoke in “Fakty po Faktach” about the findings of the team investigating irregularities in prosecutorial investigations during the rule of the United Right. Mentioning, for example, the “two towers” case, he emphasized that “no one has ever fully assessed what was the subject of the notification.” Onyszczuk also informed that “there are recommendations regarding criminal and disciplinary liability in 35 cases.”

On Tuesday at the National Prosecutor's Office a partial report on the audit of prosecutorial proceedings from the period of the United Right government from 2016-2023 was presented. It is over 300 pages long and describes 200 of 600 cases. The objections concern, among others, the “two towers” case, Beata Szydło's accident, the Kwaśniewski villa and the Lotos Group.

Prosecutor Jarosław Onyszczuk, one of the members of the team investigating these cases, spoke in “Fakty po Faktach” about the findings and what follows from them.

– Regarding the investigation into the “two towers”, he said, “there are already some opinions that the case has been discontinued and the court has upheld the prosecutor's decision.” – This is of course true and it is in our report. However, it should be remembered that the case constitutes a whole and before issuing the decision refusing to initiate (proceedings – editor's note), certain materials were excluded – he noted.

He said that the idea was “to conduct, for example, issues related to acts of corruption or other activities as part of separate proceedings, which results in such an artificial division of proceedings, just to deal with one thread and enable its quick completion.” “.

When asked whether this was the politicization of this case or the political action of prosecutors, he confirmed. – Because no one has ever fully assessed what was the subject of the notification in this case – he explained. – There was only such a separation of certain threads in the case, which were ended separately with decisions refusing to initiate, where, for example, they could not be appealed – he added.

Two towers. “This matter must be investigated in its entirety”

– We believe, without prejudging the final decision, that this case should be investigated in its entirety, taking into account all the issues that were the subject of the notification – Onyszczuk continued.

– So the three cases indicated in our report should be combined and further conducted as one investigation and explained therein. Because the prohibited acts that were the subject of this investigation absolutely require procedural steps, he said.

In the report, published on the website of the National Prosecutor's Office, the “Two Towers” case is divided into three categories: “Two Towers” – refusal to initiate; “The Two Towers” – envelope; “The Two Towers” – false testimony and others concerning the notifying party.

“This is the first step”

The TVN24 guest was asked about the criminal and official liability of prosecutors who made the now questioned decisions.

– There are recommendations regarding criminal and disciplinary liability in 35 cases. These are very different issues and they will require assessment as part of the ongoing proceedings, he said. – I think this is the first step to actually holding accountable those prosecutors who broke the law – he said.

At Tuesday's conference, a board with the results of the team's work was presented. In addition to the finding that there were significant irregularities in 163 proceedings, 35 applications for criminal or disciplinary liability were submitted. It was also noted that 14 criminal proceedings have already been initiated and are ongoing. Four official proceedings are also ongoing.
