We have not received information about the court session on the motion to exclude judge Przemysław Dziwański from considering the appeal against the refusal to apply temporary arrest to Marcin Romanowski – said on Wednesday the spokesman for the National Prosecutor's Office Przemysław Nowak. Earlier, Romanowski's attorney, attorney Bartosz Lewandowski, informed that the District Court in Warsaw did not consider the prosecutor's motion to exclude the judge from the case.
Marcin Romanowski's defense attorney, Bartosz Lewandowski, announced on Wednesday on Platform X that the District Court in Warsaw had dismissed the prosecutor's office's motion to exclude judge Przemysław Dziwański from considering the appeal against the refusal to apply temporary arrest to MP Romanowski.
– We have not received any information, we have not even been informed about a meeting on this matter – said the spokesman for the National Prosecutor's Office.
Romanowski's case and the motion to exclude the judge
PiS MPformer Deputy Minister of Justice Marcin Romanowski was detained in connection with an investigation concerning the Justice Fund. He was charged with 11 counts. He was released when the District Court for Warsaw-Mokotów rejected a motion for detention. The reason for the court's decision – as reported – was Romanowski's immunity as a member of the Parliamentary Assembly of the Council of Europe.
On August 2, the spokeswoman for the Prosecutor General, Prosecutor Anna Adamiak, told TVN24 that the prosecutor's office had filed a motion to exclude the judge from Marcin Romanowski's case, who was drawn to consider the appeal. Judge Dziwański was appointed to the position by the politicized National Council of the Judiciary.
OKO.press later reported that a judge had been appointed to the case. Judge Przemysław Dziwański of the 10th Criminal Appeal Division of the District Court in Warsaw.
– This motion (of the prosecutor's office – ed.) was about the neo-judge, who in the prosecutor's office's opinion was appointed under a flawed procedure, not dealing with this case, i.e. the case of the complaint regarding the former deputy minister of justice, responsible for the Justice Fund, not being arrested – explained TVN24 reporter Maja Wójcicka.
Marcin Romanowski's defense attorney claims that the court did not consider the prosecutor's motion. – I literally just got a text message from the prosecutor's office that there is no such official confirmation yet – Wójcikowska said before 3 p.m. As she pointed out, for now all we know is that the motion was sent to the Security Department of the District Court in Warsaw.
– But Marcin Romanowski's defense attorney claims that the prosecutor's request was not taken into account and the composition of the court will remain as it was – she added.
