National Prosecutor Dariusz Korneluk reminded that the mandate of the MP to the European Parliament “does not release the competent state authorities from stopping the perpetrator.” The issue of the immunity of MEPs became the subject of discussion in connection with the outrageous actions of Grzegorz Braun.

Korneluk: MEP Mandate does not entitle to commit a crime

Korneluk's letter was posted on Monday at the National Prosecutor's Office. We read in it that the regulations of the Act on direct coercion measures and firearms provide for “the possibility of using or using direct coercion measures, in particular if it is necessary to repel a direct, unlawful attack on life, health or freedom of an entitled or other person.”

“Therefore, there is no excuse for the passivity of the police, when in the presence of officers an assassination attempt to such goods is carried out by a deputy to the EP” – noted the national prosecutor.

“I emphasize that the mandate of the MP to the European Parliament does not entitle the person who uses it, to commit crimes, nor does it release competent state bodies from stopping the perpetrator committing the crime and pull him for criminal liability” – wrote Korneluk.

He stipulated that the concept of “capture in the act” contained in the regulations should be understood as the disclosure of the MP's crime to the EP. “This concept does not mean the obligation to detain a parliamentarian committing a crime,” the head of PK pointed out.

“The detention of a deputy to the European Parliament in the act is only allowed if the detention is necessary to ensure the correct course of the proceedings,” Korneluk noted.

He also reminded that “in each case of arrest of the EP MP, including in the act of committing a crime, it is necessary to notify the chairwoman of the European Parliament.”

The European Parliament will vote for the opening of Braun's immunity

The issue of the scope of immunity became the subject of discussion in connection with the activities of the MEP and the candidate for president Grzegorz Braun (excluded from the Confederation), who in mid -April tried to prevent the work of Gynecolor Gyzela Jagielska in a hospital in Oleśnica. The doctor, reporting on the event, said that Braun invaded the administrative department, blocked her path and locked her in the administrative room.
