I am wondering whether to submit an application to the prosecutor's office against Krystyna Pawłowicz, said Szymon Hołownia, Marshal of the Sejm. He referred in “Kropka nad i” to its decisions made at the meeting of the Constitutional Tribunal last week. As he said, “she ruled in her own case of excluding herself” and “broke the law by imposing a penalty on the MP.” Hołownia emphasized that he “does not rule out” legal action. – I have a clear opinion from our legal office that I can do it – he added.
Last week Constitutional Court Julia Przyłębska considered a case referred there by the president, in which Andrzej Duda questioned the law adopted by the Sejm after the expiry of the parliamentary mandates of convicted PiS politicians Mariusz Kamiński and Maciej Wąsik.
The Polish MP 2050 Paweł Śliz came to the hearing and He requested the exclusion of Krystyna Pawłowicz and Stanisław Piotrowicz from the panel of judges – who are exes PiS MPs and were elected to the Tribunal during the PiS government, with the votes of the parliamentary majority of the previous government. After the motion was rejected, he left the room, which made Pawłowicz angry. Later she announced that the Constitutional Tribunal had imposed a penalty on the MP. Shortly later, the Tribunal also announced that the act was inconsistent with the provisions of the constitution.
Hołownia “does not rule out” reporting to the prosecutor's office in Pawłowicz
Marshal of the Sejm and leader of Poland 2050 (co-leader of the Third Way) Szymon Hołownia in Wednesday's “Kropka nad i” on TVN24 referred to this meeting of the Constitutional Tribunal.
Hołownia said that in his opinion Krystyna Pawłowicz “she ruled in her own case, excluding herself as a former party friend of the people concerned, and she also broke the law by imposing a penalty on a deputy who represented the Sejm.”
– I am wondering whether to submit an application against her to the prosecutor's office, because the Act on the exercise of the mandate of a deputy and senator clearly states that such things cannot be done to a member of the Sejm – said Hołownia.
When asked whether he would submit such a request, he replied: – I don't rule it out. (…) I have a clear opinion from our legal office that I can do it. I will consider whether to do this.
