On February 1, 2025, new regulations enter into force free from work on December 24 on Christmas Eve. The changes also apply to the next Sunday without a ban on trade.

Trade changes and a new day off from work

As explained at the end of December 2024, the head of the Chancellery of the President of the Republic of Poland Małgorzata Paprocka, the president made such a decision due to the comments of trade unions that the regulation discriminates against trade employees. It is about introducing an additional commercial Sunday.

The subsequent control mode predicts that it is only Constitutional Tribunal may repeal the power of applicable regulations if it recognizes their non -compliance with the constitution. Until now, the Constitutional Tribunal has not taken a position on this matter. So it means that The regulations will enter into force on February 1, 2025.

More commercial Sundays and free Christmas Eve

This means that in 2025 another – third in December – Sunday without trading will be introduced. Importantly, the Act reserves that a specific employee may work at most two Sundays this month.

Therefore, in 2025 there will be eight, and not, as before, seven commercial Sundays were planned. In December, shopping in larger facilities can be done 7, 14 and 21 December.

Trade Sundays in 2025

The Act provides Also establishing on December 24 – Christmas Eve – a day off from work. In 2025, Christmas Eve falls on Wednesday. This means that the Christmas break with the weekend will last continuously five days (including December 25 and 26).

Trade ban on Sunday

The Act gradually introducing a ban on trading on Sundays entered into force on March 1, 2018. From 2020 to February 1, 2025, the trade ban did not apply on seven Sundays in the year: last Sundays of January, April, June and August, as well as on Sunday before Easter and on two consecutive Sundays preceding Christmas.

“On Sundays and holidays, trade and trade activities are prohibited in commercial facilities, as well as entrusting to an employee or employed (including a person performing work in a commercial institution under a civil law contract such as a mandate contract) work in trade and performing work trade activities.

The act limiting trade on Sunday provides for a 32 exclusion catalog. The ban does not include, among others postal activity, if revenues from this activity constitute at least 40 percent. revenues from the sale of a given facility. In addition, it does not apply in confectioneries, ice cream parlors, liquid fuel stations, in florists, in press stores or in cafes.

For breaking the trade ban on Sundays, it is threatened with PLN 1,000 to PLN 100,000. PLN penalty, and with persistent violation of the regulations – the penalty of restriction of liberty.
