The ball will be on the desk of the Minister of Finance or other entities that will have to assess what to do in such a situation – said Professor Włodzimierz Wróbel, a judge of the Supreme Court, in “Fakty po Faktach”. He was asked about the fate of the PiS electoral subsidy if an appeal against a possible rejection of the report by the National Electoral Commission were to be considered by an unrecognized chamber of the Supreme Court created during the PiS government.
National Electoral Commission did not make a decision last Wednesday (31 July) on the financial report of the PiS electoral committee for the parliamentary elections in 2023. The Committee adjourned the meeting on this matter until 29 August.
If the National Electoral Commission rejects PiS's report, the group will be able to appeal to the unrecognized Chamber of Extraordinary Control and Public Affairs of the Supreme Court, established under the party's rule. The chamber's decision in this case would then go to the desk of the finance minister, who deals with the budget, including funds for subsidies for political parties.
Wróbel: There are many more questions for the minister
The case was commented on in “Fakty po Faktach” on TVN24 by Professor Włodzimierz Wróbel, a judge of the Supreme Court. – We know one thing for sure – and this from the rulings of international courts, but also from the rulings of the Supreme Court – this chamber is a special court, it is something at the Supreme Court, but it does not have the characteristics of a court – he said, describing the Chamber of Extraordinary Control and Public Affairs.
– It is some kind of body created by politicians, probably for situations like this, to create such safety ropes – he added. He stated that the chamber's decision on the subsidy for PiS “will not be a judicial decision for this reason”.

He also referred to the situation of the Minister of Finance. – This is the same Minister of Finance who proposes a budget that still provides for financing for this “special court” banned by the constitution. This budget still provides for financing for people who illegally sit on the Constitutional Tribunal. There are also many more questions for the Minister here – he added.
