Białystok's unexpected debt: The bailiff seized PLN 472,000 from the account of the Białystok commune. This is a debt that was transferred to the city because the deceased woman registered in the city had no relatives. In such a situation the debt is taken over by the local government. Officials say this in itself is not unheard of, but other cases have been more serious lower amounts. There was a lot of build-up around the whole situation controversy.
Białystok accuses the bailiff: The city hall claims that until the value of the inheritance is determined, the bailiff couldn't take the money from the city account. And yet he did it even though “the decisions of the District Court in Białystok show that no valid enforcement orders were issued against the defendant, who was the deceased – the testator of the Białystok Commune.” The city claims that bailiff proceedings have therefore been carried out unfoundedly and prematurely.
Bailiff's response: Białystok was to be properly notified about the initiation of bailiff enforcement, claims Przemysław Małecki, spokesman for the National Council of Bailiffs. However, the city was supposed to respond to the notification the court dismissed the complaint – says Małecki. He reminded that the bailiff always acts on the basis of court decisions, and this case was no different.
City hall problems: Due to the approaching end of the year, such a large bailiff's activity must be included in the city's expenditure plan, which would allow it to be shown in the annual report. The Białystok City Hall explains that after making corrections and arrangements, the city hall expects that the money will return to it as the city's revenue.
