Work on the draft bill improving prosumer settlements has been completed, informed the Minister of Climate and Environment, Paulina Hennig-Kloska. She added that in September the draft will go to the Council of Ministers and then to the Sejm. According to the current draft, the refund of overpayments in the net-billing system will be increased from 20% to 30%.

“Work on the act improving the settlement of prosumers has been completed. The project will go to the Council of Ministers meeting in September and then to the Parliament,” Hennig-Kloska wrote on social media.

Draft amendment to the act on renewable energy sources and certain other acts authored by the Ministry of Culture and Environment provide, among other things, that prosumers will be able to decide whether they want to be billed in net-billing based on the monthly market price price of electricity or hourly price. If the hourly option is chosen, prosumers will receive a bonus.

Net-billing involves the prosumer selling the surplus energy they produceand if necessary, buys it. However, he does not receive the money in hand, and settlements are made via the prosumer account from which the energy is purchased.

Net-billing replaced the previous net metering, based on a discount system. According to the previous method, the prosumer settled for energy quantitatively. For one unit of energy introduced to the network, he could receive 0.8 for free. In larger installations, this ratio was from 1 to 0.7.

According to the current project, the refund of overpayments in the net-billing system will be increased from 20% to 30%.

Renewable energy, permits, reliefs in the new project

Moreover, in accordance with the designed solutions, the deadlines for investment procedures for selected RES installations are to be shortenedincluding those mounted on the roofs of buildings photovoltaic panels and energy storage facilities, heat pumps, devices and installations necessary to connect a given RES installation to the grid located in the same area.

The acceleration is to apply to the issuance of decisions on building permits; conditions for connection to the electricity and heating grid; concessions for electricity generation or concessions for heat generation; decisions on environmental conditions; and entries in the register of producers performing business activity in a small installation.

The draft act is also to update the list of sectors eligible for relief for energy-intensive customers in accordance with the catalogue specified in the EU guidelines on state aid for climate and environmental protection (CEEAG). Two levels of relief are to be introduced: for entrepreneurs in sectors particularly exposed to the risk of carbon leakage at 85% of the obligation and for companies in sectors exposed to the risk of carbon leakage at 75%.

The new regulations will also introduce a compensatory fee paid by energy-intensive consumers eligible for relief.

In addition, the proposed regulations are to exclude support for electricity from renewable energy sources generated in waste incinerators, except for high-efficiency cogeneration. It will also not be possible to provide aid for the construction of new coal-fired cogeneration units.
