“No law was broken.” They are finishing the investigation into the accident of the police chief

On Monday, the prosecutor's office will formally close the investigation into the circumstances of the road accident of Chief Police Commander Marek Boroń – according to unofficial information from tvn24.pl. – There was no violation of the law, hence the decision to discontinue the proceedings – says our interlocutor.

Currently, the investigation is being conducted by the District Prosecutor's Office in Gliwice, which took it over from a lower-level prosecutor's office. On site accident – which occurred on September 14 – evidence was secured under the supervision of the deputy district prosecutor in Tarnowskie Góry, Magdalena Lewandowska-Smerd.

– There was no violation of the law, hence the decision to discontinue the proceedings. The prosecutor is finishing writing the justification for closing the proceedings, says our interlocutor from the prosecutor's office, speaking on condition of anonymity.

On September 14, an experienced police driver was behind the wheel of a BMW X5 official car, in which General Boroń and his assistant were traveling. The route led from the Police Headquarters to Głuchołazy and further to the areas most affected by the flood.

Just before 6 p.m. the vehicle was already on the A1 highway, near the town of Szałsza. The driver lost control of the vehicle, hit the concrete barriers head-on, and then the car rolled several times. All the airbags in the car deployed and all three were strapped in. Commander Boroń, his assistant and the driver were taken to hospital. It turned out that they only had contusions.

Two expert opinions

The prosecutor's office initiated an investigation because the possible perpetrator was a policeman. Due to the person of the Chief Commander, the case was taken over from the district prosecutor's office by a higher-level prosecutor's office. Investigators ordered two key opinions. The doctor assessed the nature of the injuries, which was important from the point of view of qualifying the event. – The point is to determine whether the injuries resulted in treatment of less than seven days or more – explained Karina Spruś, spokeswoman for the Gliwice prosecutor's office.

According to the definition of the Penal Code, if the injuries require hospitalization for more than seven days, an offense under Article 177 of the Penal Code is involved.

Whoever, violating, even unintentionally, the rules of safety in land, water or air traffic, unintentionally causes an accident in which another person suffered bodily injuries specified in Art. 157 § 1, is punishable by imprisonment for up to 3 years.

Meanwhile, the commander, his assistant and the driver left the hospital the next day. Their injuries were mainly contusions related to the pressure of seat belts and exploding airbags. The investigators ordered another opinion from an automotive expert. He was supposed to answer questions about, among others: technical condition of the car, determine the speed at which the accident occurred.

The decision to discontinue the investigation is the result of the prosecutor's analysis of these two documents. According to our interlocutors from the Ministry of Interior and Administration, the speed slightly exceeded 100 km/h. – The accident was the result of aquaplaning (loss of grip on wet surfaces – ed.). The car hit a puddle, even an experienced and trained driver was unable to cope with the loss of grip – says our interlocutor.

The analysis of the accident and all circumstances was carried out at the Internal Supervision Office of the Ministry of Internal Affairs and Administration. – On the one hand, no one would accuse us that we did nothing, as was the case with the grenade launcher. On the other hand, to find out what mistakes were made so that the accident of the police chief or other VIPs would not be repeated – we heard from the ministry.
