Defenders of two men accused of shooting with firearms Zuzanna G.-M., when, after terminating the lease of the apartment and their parents, she came to pick up the keys, they appealed against the sentence. Sebastian Sz. In the first instance he heard a sentence of 10 years in prison, Mateusz M. – 8 years old. The defender of the first man wants a change in the qualification of the act and the possible reconsideration of the case, the defender of the second acquittal of his client.

The appeals of both lawyers went to the District Court in Rzeszów, i.e. the court of first instance. Through it, appeals will then be forwarded to a higher court, i.e. to the Court of Appeal in Rzeszów.

27-year-old Sebastian Sz., From the Rzeszów poviat and his peer Mateusz M., a resident of Tarnobrzeg, the prosecutor's office accused of attempted the murder of Zuzanna G.-M., a resident of Rzeszów. It was shot by one of the men with a self -potential pistol in the hand and stomach.

These are penalties slightly lower than those that the prosecutor demanded in the final speech. He demanded 15 years in prison for Sebastian Sz., Who, according to the accusation, was the main leader of the event, and for Mateusz M. – 13 years in prison.

He also reserved that they could apply for conditional dismissal after 12 and 10 years imprisonment, respectively.

According to the prosecutor's office, the accused had previously prepared for the use of weapons and gas that it was planned. This is to be confirmed by SMSs secured in the evidence between the accused who did not want to move out of the rented apartment.

The defenders in the end speeches requested acquittal.

Sebastian's lawyer – Andrzej Mucha announced on Wednesday that in his appeal he demanded for his client a change in the legal qualification of the act from attempted murder of unintentional causing bodily injury in the necessary defense or possibly setting aside the contested judgment and being re -examined.

In turn, the defender Mateusz M. – Bartosz Rogała – requested the acquittal of his client. As he said, he questions the agreement between both men at all that they acted jointly and in agreement.

“If there was no agreement, taking into account this action in the necessary defense, the resolution of the attack was adequate to the behavior of people who came to pick up the apartment and therefore I am asking for acquittal” – explained Rogała.

It is about the case of July 15, 2022. The owner of the apartment in the center of Rzeszów at ul. Siemiradzkiego Małgorzata G. after prior termination of the lease agreement to Sebastian Sz. It came, among others With her husband and daughter Zuzanna to pick up a flat and keys from him. The owner also called the locksmith to open the door if the landlord did not leave the premises within the time limit.

According to the prosecutor's office, no one opened the door of the apartment at the owner's call, no sounds could be heard from the inside, no one answered, so the decision was made to open the locking lock.

“When the locksmith started opening the lock, the door was opened from the inside, and then at the same time towards people who were in front of the apartment from inside, Mateusz M. used pepper gas, and Sebastian Sz. He fired a shot from a firearm, as a result of which Zuzanna G.-M. standing at the door was shot.” – reported spokesman for the District Prosecutor's Office in Rzeszów, prosecutor Krzysztof Ciechanowski.
