During the three-day session that begins today, the Sejm will consider, among others, the draft of the so-called incidental law regarding the certification of the validity of the presidential elections and the sanctions law. MEPs will also get acquainted with the program of the Polish Presidency of the Council of the European Union and vote on the Senate's amendments to the budget act.
On Wednesday morning, the Sejm will get acquainted with the “Program of the Polish Presidency of the Council of the European Union (January 1 – June 30, 2025)”, submitted by the Minister for European Union Affairs Adam Szłapka. There will be a discussion on the document.
The document emphasizes that “Poland is taking over the presidency of the Council of the European Union in a period of uncertainty and anxiety. Europe is facing the effects of Russia's armed aggression against Ukraine, which is in its third year, and the need to strengthen its own defense potential.”
“We are observing growing geopolitical tensions, the erosion of the rules-based international order and hybrid attacks against European democracy and security. Europeans are affected by the effects of migratory pressure, energy transformation, declining competitiveness of the European economy and climate change,” we read.
The Sejm will deal with the so-called project incidental act
After this point, the Sejm will hold the first reading of the parliamentary bill on special solutions in the field of judicial recognition Supreme Court matters related to the elections of the President of the Republic of Poland and by-elections to the Senate of the Republic of Poland, ordered in 2025.
The so-called project the incidental act submitted by Polska2050-TD refers to the Supreme Court's resolution of cases regarding this year's presidential elections.
The project provides that the validity of these elections would be decided by three chambers of the Supreme Court: Criminal, Civil and Labor, and not by the Chamber of Extraordinary Control and Public Affairs of the Supreme Court, which – as stated by, among others, European Courts – is not an independent court within the meaning of EU law.
In December, Marshal of the Sejm and leader of Poland 2050 Szymon Hołownia informed that he met with the chairmen of parliamentary clubs and groups, to whom he presented the project of the so-called incidental law regarding the presidential elections.
On the same day, Hołownia met with the president Andrzej Dudato present this project to him. Duda said after the meeting that he was “open to discussion on various legislative ideas, also when it comes to the Supreme Court, especially since it is generally stated in the constitution that the Supreme Court decides, so here, of course, various legal modifications can be made.”
Sanctions bill in the Sejm
The MPs will also read the committee's report on the government project of the so-called the Sanctions Act, i.e. amending the Act on special solutions for counteracting support for aggression Ukraine and those serving to protect national security, the Act on the National Tax Administration and the Act on Counteracting Money Laundering and Terrorist Financing.
The project proposes adapting the current wording of the provisions of national law to the changes introduced in EU regulations, “on the one hand, in terms of supplementing the catalog of derogations from EU sanctions, and on the other hand, in terms of supplementing the catalog of prohibitions that are subject to administrative penalties (the Act on the National Revenue Administration) and sanctions criminal (sanctions act)”.
Wednesday in the Sejm
The second reading of the bill on establishing the National Day of Remembrance of Home Army Soldiers will also take place on Wednesday. The authors of the project propose to establish February 14 as the National Day of Remembrance of Home Army Soldiers.
The Sejm will hear the report of the Committee for Energy, Climate and State Assets on the draft amendment to the Capacity Market Act. It concerns the introduction of supplementary auctions on the capacity market from the second half of 2025 to 2028. Additional power will be purchased in auctions to ensure energy security in our country.
On Wednesday, the Sejm will hold the first reading of the government's draft amendment to the Act on granting protection to foreigners in the territory of the Republic of Poland. The project concerns the introduction of the possibility of temporarily limiting the right to submit an asylum application and the introduction of additional grounds that will enable the deprivation of refugee status.
The new regulations are aimed at strengthening border protection by counteracting the phenomenon of exploitation of migration by Belaruswhich in cooperation with Russia and international criminal groups organizes the transfer of migrants to the European Union.
Deputies will also hear the report of the culture committee on the draft resolution on commemorating the 80th anniversary of the Upper Silesian Tragedy.
