– The procedure is somewhat complicated and may still provoke various twists and turns within the proceedings – said Professor Marek Safjan, former judge of the CJEU, former president of the Constitutional Tribunal in “Fakty po Faktach”. He commented on the applications to lift the immunities of MEPs Mariusz Kamiński and Maciej Wąsik, which were submitted today by Prosecutor General Adam Bodnar to the President of the European Parliament Roberta Metsola.

– This is a slightly different situation than in the Parliamentary Assembly. The status of a Member of the European Parliament is a fully independent status. It is independent, it is not a status derived from a national MP. Just because someone is a national MP, they then become a member of the Parliamentary Assembly in the Council of Europe. Here it is completely independent and autonomous – he said.
– Secondly, let's remember that the regulations of the European Parliament are much more precise. The regulations in this matter, and even the protocol on immunities, they are much more precise and precise in the matter of the procedure than it is in the case of the Council of Europe – he continued.
– And thirdly, let us remember that in the case of the European Parliament there is still the possibility of proceedings before the Court of Justice – he added.
