At a press conference, Minister of Digital Affairs Janusz Cieszyński explained to journalists how the new service will work. – The assumption is that banks, telecoms and notaries will gradually integrate with the system. This means that by June 1 we will reach a situation in which all institutions will be obliged to use the reservation register and will be ready to do so – said Janusz Cieszyński, Minister of Digitization, on Thursday, referring to the new service in which citizens can reserve their number. The solutions regarding the reservation of the PESEL number itself and the withdrawal of such reservation will come into force on Friday.
Janusz Cieszyński: from June 1, all institutions in the system
During the Thursday conference, Minister of Digital Affairs Janusz Cieszyński emphasized that this is a service that will be implemented in two stages, and the first one begins on Friday with the launch of the register of objections. – The register of objections will be kept in the infrastructure of state registers, just like the PESEL register, the register of ID cards or the register of voters. The idea is to build it on infrastructure that has the highest level of reliability, explained Cieszyński.
He noted that in the coming months, until June 1, 2024, the register will be filled with citizens’ consents to reservations and that the system will be integrated.
– This means, in short, that by June 1 we will reach a situation in which all institutions that will be obliged to use this register from June 1 will be ready to do so. The idea is to avoid a situation in which there will be a large implementation from one day to the next, involving thousands, hundreds of thousands, if not millions of operations a day – he explained.
At the same time, he encouraged all companies, banks and institutions to “integrate as quickly as possible so that there will be no disruptions on June 1.”
– If someone submits such a reservation to the register and someone on his behalf concludes an agreement during that time, the agreement will be invalid by operation of law, i.e. if someone extorts a loan from us, the entire responsibility for the loan in such a situation will fall on us. the institution that granted this loan – he explained.
He also explained how the regulations may operate until June 1. – If a bank that integrates with this system, and I think that the first banks will appear within a few, maybe a dozen or so weeks, knows that PESEL is confidential, it will not conclude an agreement for this data, because it will simply focus on his own interests, he will have a very serious reason to assume that a given person does not want to take out this loan – he explained.
Reservation of the PESEL number – new regulations
The possibility of blocking the PESEL number is provided for in the Act amending certain acts in order to limit certain effects of identity theft. This includes: to fight against the fraud of financial resources by, for example, taking out a loan for another person without his or her knowledge and consent. The so-called phenomenon is also to be combated in this way. SIM swapping, i.e. creating a duplicate SIM card, which can then be used to illegally authorize transactions.
From June 1, 2024, entities such as banks, credit institutions or notaries, before concluding a contract or taking action, will have to check in the register whether the PESEL number of a given person has been restricted. The Act states that citizens will not be charged for an obligation that was incurred without their knowledge despite the existing reservation.
The solutions regarding the reservation of the PESEL number itself and the withdrawal of such reservation will come into force on Friday. Pursuant to the Act, this will be possible for any adult holder of a PESEL number using the e-service, the mObywatel application – there will be a “Zastrzeż PESEL” service – or in person at a commune office, a national bank, a cooperative savings and credit union or a post office.
