On Wednesday, the letters of the Speaker of the Sejm regarding the appeals of Mariusz Kamiński and Maciej Wąsik against Szymon Hołownia’s decision to terminate their parliamentary mandates are to be submitted to the Supreme Court – TVN24 reporter Sebastian Napieraj said. He explained that the seven-day deadline would then begin to run, during which the Supreme Court would have time to deal with the case.

Maciej Brzózka from the press team of the Supreme Court informed on Friday that the Chamber of Extraordinary Control and Public Affairs of the Supreme Court had received appeals by Mariusz Kamiński and Maciej Wąsik against the decision of the Speaker of the Sejm to expire their parliamentary mandates. Stanisław Zakromski, head of the Office of the Speaker of the Sejm, said that appeals were also submitted to the Chancellery of the Sejm.

– Since we are not sure and trust the correctness of the action on the part of the Speaker of the Sejm, we are filing appeals against the expiry of the mandate to both bodies, i.e. the Supreme Court and the Speaker – said Mariusz Kamiński’s defender, attorney Michał Zuchmantowicz.

Pursuant to the regulations, the decision of the Speaker of the Sejm may be appealed against to the Supreme Court within three days from the date of its delivery. Such an appeal should be submitted to the Supreme Court through the Speaker of the Chamber.

What about the appeals of Kamiński and Wąsik?

As TVN24 reporter Sebastian Napieraj reported on Wednesday, the appeal of Kamiński and Wąsik from the Speaker of the Sejm has not yet reached the Supreme Court.

According to the TVN24 reporter’s findings, this will happen today. He added that the seven-day deadline will then begin to run, during which the Supreme Court has time to deal with the case.

Napieraj said that the fundamental question is which chamber of the Supreme Court will consider these appeals. He added that everything indicates that it will be the Chamber of Extraordinary Control and Public Affairs, which, according to many legal experts, will consist of so-called neo-judges appointed by the neo-KRS politicized by PiS.

The remaining former heads of the CBA were sentenced to one year in prison.

On December 21, the Speaker of the Sejm, Szymon Hołownia, informed Fr expiry of the parliamentary mandates of Wąsik and Kamiński. President Andrzej Duda in a letter to the Speaker of the Sejm previously indicated that as a result of the application of the law of pardon in 2015 to Kamiński and Wąsik, who were then illegally convicted by the court of first instance, there are no grounds for expiring the mandate.
