The investigation into the tragic accident in Ursynów has ended. The driver who fatally hit a pedestrian on a zebra wants to voluntarily submit to punishment. Her application is already in court.
The incident occurred on June 19, 2023. As we reported then, the driver of the Skoda, a 46-year-old Czech citizen, failed to give way to a pedestrian at a marked crossing without traffic lights. The man died.
The prosecutor's office initiated an investigation. Now, as Szymon Banna, spokesman for the District Prosecutor's Office in Warsaw, informs us, the proceedings have already ended. The court received an indictment and a request for voluntary submission to punishment.
She faces eight years in prison
Let us remind you that the woman was charged with causing a fatal accident, for which she faces eight years in prison. Witnesses pointed out to the prosecutor's office that the 46-year-old did not slow down or brake just before the pedestrian crossing.
An accident reconstruction expert was also appointed in the case. The specialist estimated that the driver's speed could have been around 67 km/h. Moreover, the expert pointed out that “the causes of the accident should be attributed to the incorrect behavior of the Skoda driver, who did not exercise the required special caution when approaching a properly and clearly marked pedestrian crossing.”
He also found that “there are no grounds to blame Daniel S. for contributing to the accident.”
Application for voluntary submission to punishment
The driver pleaded guilty. He wants to voluntarily submit to punishment. The application, as Szymon Banna informed us, is already in court.
What punishment does he propose? As we found out, the driver agreed to one year in prison suspended for three years, to pay compensation to the deceased's family in the amount of PLN 100,000 and to be banned from driving for two years.
