She threw the dog from the fourth floor of the building. The animal did not survive the fall, it died in agony. The District Court in Aleksandrów Kujawski sentenced the woman to one year and six months in prison, banned her from owning animals for 10 years and ordered her to pay a surplus to the shelter. The judgment is not final.
The incident took place on July 14, 2022 in one of the apartments in Ciechocinek (Kuyavian-Pomeranian Voivodeship). The 13-year-old dog Oskar stayed thrown from a balcony on the fourth floor of a building. He fell on the concrete. The animal could not be saved.
According to the investigators, on that day in the apartment from which the dog was thrown, there was m. Marta C. She and other people drank alcohol. At the time of arrest, the woman had about three per mille in the body. The prosecutor’s office charged her with cruelty to an animal. The woman pleaded guilty.
Absolute imprisonment for the death of a dog
In October 2022, the trial against Marta C began before the District Court in Aleksandrów Kujawski. It ended on Monday (January 9).
– At the trial, Dariusz K., the owner of the dog, appeared as a witness. Now, at my request, he was brought to court by the police – said tvn24.pl lawyer Anita Engler, who represented the Toruń Society for the Protection of Animal Rights in the case.

Dariusz K. was supposed to be absent from the apartment when the accident happened, and the animal supposedly fell out of the woman’s hands on the balcony because it did not like the smell of alcohol. However, the man was so unreliable that the court was not convinced by these explanations, the lawyer reported.
The court sentenced the accused to one year and six months of absolute imprisonment. He also banned her from owning animals for 10 years and ordered her to pay a surcharge of PLN 2,000 to an animal shelter. He also changed the legal qualification of the act. The defendant was convicted not of cruelly mistreating an animal, but of killing a dog with extreme cruelty.

– The verdict is not final. Will anyone complain to him? I do not know. Defendant certainly not, because she agrees with him. I and the foundation, which was the auxiliary prosecutor, are satisfied with this. Prosecutors asked for a nine-month prison sentence and a five-year ban on owning animals. However, the court issued a verdict in which the accused received 1.5 years in prison and a 10-year ban on owning animals, Engler informed. She added: – The court also took into account the mitigating circumstances. The woman pleaded guilty and showed remorse. This is appropriate given the case law in such cases.
The Mondo Cane Foundation for the Protection of Animal Rights, which was one of the auxiliary prosecutors, is also satisfied with the court’s verdict. “We are happy, although it is joy through tears, when we imagine how the life of an old dog who loved people and could not expect someone to treat him like this ended” – we read in a comment published on social media.
