Dawid Ż., suspected of shooting a man in a bar in the center of Krakow in February and attempting to kill another, was insane at the time of the incident, according to experts. This means that he will not be held criminally responsible for his actions. – In such cases, the prosecutor’s office is obliged to discontinue the proceedings – prosecutor Leszek Brzegowy from the District Prosecutor’s Office in Krakow told us. The 35-year-old suspect may be sent to a psychiatric institution by court decision.
According to the experts, Dawid Ż., suspected of shooting a man in one of the bars on Sławkowska Street in the very center of Krakow, was insane at the time of the alleged act. This fundamentally changes his situation, because in such a system the 35-year-old will not be punished for his act.
As prosecutor Leszek Brzegowy from the District Prosecutor’s Office in Krakow told us, “in such cases, the prosecutor’s office is obliged to discontinue the proceedings.” – However, if this insanity is a threat to the legal order in the future, proceedings will be initiated for the application of protective measures, such as placing in a psychiatric institution. The decision in this regard is then made by the court, the prosecutor noted.

The tragedy happened on February 9 in the morning. The findings show that 35-year-old Dawid Ż. He entered the bar with a gun in his hand and shot one of the men in the barand then tried to shoot at the other. But then his gun jammed and it didn’t fire.
The shot man was resuscitated, but unfortunately he could not be saved. The other was hospitalized due to the shock he suffered.
