A family of three burned down in a car near Piotrków Trybunalski. From the very beginning, Internet users were convinced that the BMW driver contributed to this tragedy. The prosecutor’s office announced that a decision had been made to charge him. This does not mean that he was charged. The Minister of Justice admits that the 31-year-old is wanted.

An entire family of three died in an accident on the A1 motorway. The prosecutor’s office does not inform that it has brought charges against the driver, only that such a decision has been made. “I confirm that based on the evidence collected in the case, the decision was made to present a charge. At the moment, we do not provide any further information in this regard,” the prosecutor’s office says.

– I don’t understand what it means that they decide to press charges. Well, either they brought charges or they didn’t bring charges, commented Adam Szłapka, an MP from the Civic Coalition. This inaccuracy is explained by Prosecutor General Zbigniew Ziobro:

– The driver’s family, the family representative, assures that the driver will appear before justice. However, the prosecutor in this case, on my instructions, nevertheless took all necessary actions to ensure the arrest and bringing of the suspect to justice. I also gave an order that the image of the perpetrator be made public in connection with the issuance of an arrest warrant, said Zbigniew Ziobro.

What really happened to the BMW driver? This was explained by the prosecutor general only after questions from journalists. – He’s wanted right now. He is intensely wanted. These searches are already going on very intensively and on a large scale – assures Ziobro.

This means that two weeks after the accident, the man who most likely caused the death of three people fled before the prosecutor brought charges against him. Earlier, Zbigniew Ziobro, who declared that he had personally supervised the investigation, announced that after examining the records of the recorder in the crashed car, it was established that at the time of the accident the driver was traveling at a speed of at least 253 kilometers per hour. It is worth adding that at 250 kilometers per hour we travel about 80 meters in one second. The recordings show that a moment before the accident, the BMW could have been going even faster, and the speed could have dropped literally fractions of seconds before hitting the rear of the Kia car.

Even the firefighters present at the scene had no doubts from the very beginning that the speeding BMW was involved in the accident. – The person in charge of the rescue operation listed the preliminary probable cause of this event as “one display crashing into the back of another” – said Junior Brig. Jędrzej Pawlak from the Provincial Headquarters of the State Fire Service in Łódź.

During the conference, the prosecutor’s office assured that the responsibility of the BMW driver for causing this accident was also taken into account from the very beginning. This raises even more questions. While prosecutors often justify their restraint in providing information as “the good of the proceedings”, in this case prosecutor Magdalena Czołnowska was unable to even answer the question of whether the collected recordings were the same ones that were published on the Internet.

At the same time, there were appeals for people who were the authors of the recordings to report to investigators. The prosecutor’s office explains that the recordings of the moment of the accident cannot be included in the evidence until their authors are identified. – They cannot be used as evidence of these proceedings because it is not known who they come from or whether they are actually recordings from this event – explains Magdalena Czołnowska from the District Prosecutor’s Office in Piotrków Trybunalski.

– Let’s assume that the case goes to court and the defense will question this recording. She will question the truthfulness, she may question the truthfulness – says Deputy Minister of Justice Sebastian Kaleta, PiS Committee. Such recordings may be weak evidence in court, but the question remains why the prosecutor did not use them when making decisions about the BMW driver. Why, in an accident in which an entire family of three burned down, no decision was made to stop him at least temporarily. – With two cars on site, one burned and the other smashed, such activities should be performed immediately. In my opinion, what happened is simply unthinkable. This is a scandal – says Mariusz Podkalicki, Safe Driving Academy “Podkalicki Prodriving”. On Tuesday, the prosecutor’s office assured that the investigation “is being conducted dynamically” and “in accordance with the principles of technique and tactics of preparatory proceedings.”
