The District Court in Kraków stated that there were no grounds for Judge Waldemar Żurek to refrain from working in the department to which he had been transferred. This is the next stage of the case that Judge Żurek brought to the District Court in Krakow, accusing the management of this unit, among other things, of mobbing.

Judge Waldemar Żurek brought a case to the District Court in Kraków, accusing the management of this unit of i.a. bullying. On March 15, the labor department of the District Court issued a verdict in the trial of the first instance, taking into account most of Judge Żurek’s motions, including on transferring him in August 2018 to another department of the Krakow court.

In mid-March, the court in Katowice reinstated Judge Żurek to adjudicate in the department from which he was transferred – under the rigor of immediate enforceability. Earlier, on March 3, the Katowice court considered securing the judge’s claim in this point, i.e. reinstating him to the 2nd appellate division at the District Court in Kraków. This security was enforceable.

On Saturday evening, a spokeswoman for the District Court in Kraków, Judge Beata Górszczyk, sent a link to the statement issued that day, in which she informed about the change of the decision of the District Court in Katowice of March 3 and the dismissal of the claimant’s application Waldemar Ż. for a security.

“The District Court in Katowice, 11th Labor and Social Insurance Division, composed of three judges, having examined the case on April 28, 2023 in Katowice, based on the application of Waldemar Ż. against the District Court in Kraków with the participation of the District Prosecutor in Katowice, acting as a result of a complaint from the plaintiff, the defendant – the District Court in Kraków and the District Prosecutor in Katowice against the decision of the District Court in Katowice of March 3, 2023, case No. XI P 33/20, taking into account the position presented by the District Court in Kraków, changed the indicated decision of the District Court in Katowice of March 2023 and dismissed the claimant’s motion, Waldemar Ż., for security ordering the District Court in Kraków to entrust the claimant with official duties in the 2nd Civil Appeal Division of the District Court in Kraków and to release him from performing any official duties resulting from the division of duties of August 27, 2018” – wrote Judge Górszczyk.

“The complaint of the plaintiff Waldemar Ż. was dismissed” – she noted.

“Thus, the position of the authorities of the District Court in Kraków has been confirmed that there are no grounds for the plaintiff to refrain from performing official duties in the 1st Civil Division of the District Court in Kraków” – indicated the spokesperson of the Kraków court.
