The District Court in Zamość (Lubelskie Voivodeship) upheld the complaint of the defender of a 16-year-old boy suspected of involvement in the fatal beating of 16-year-old Eryk and decided that the boy would leave the juvenile shelter and be free under the supervision of a probation officer.
The tragedy happened at ul. Józef Piłsudski in Zamość, near the Old Town. 16-year-old Eryk, walking along the sidewalk, was allegedly accosted and beaten by a group of youth. The perpetrators then fled the scene. Despite resuscitation by the ambulance crew, the boy’s life could not be saved.
Two charged persons on the loose
The murder suspect, 17-year-old Daniel G., is in custody. The remaining two 16-year-olds: Szymon J. and Arkadiusz P., who are suspected of participating in the beating, were first placed in a juvenile shelter, and 16-year-old Gabriela P., charged with aiding and abetting, was placed in an educational center. After the girl’s lawyers and one of her peers lodged complaints, the District Court in Zamość overturned the earlier decisions. Therefore, the two suspects have been at large since the end of April, they were temporarily supervised by a probation officer.
By court decision, the 16-year-old will leave the shelter
A spokeswoman for the District Prosecutor’s Office in Zamość, prosecutor Anna Rębacz, informed on Thursday about the latest decision against the third of the 16-year-olds who had been staying at the shelter so far. “Recognising the complaint of the minor’s defender, the District Court in Zamość changed the decision of the court of first instance to extend his stay in the shelter and applied a temporary measure of liberty, also in the form of supervision by a probation officer,” the spokeswoman said.
She added that the decision is final and not subject to appeal.
When asked about the stage of the investigation, she said that the prosecutor’s office is currently waiting, among other things, for a psychiatric and psychological opinion regarding the main suspect, Daniel G., as well as for a supplementary opinion in the field of forensic medicine.
Alleged rumors
Preliminary findings show that the reason for the beating was the alleged dissemination of news at school about one of the detained persons. According to local media, it is about a 16-year-old girl who has been charged with aiding and abetting.
The main suspect faces up to 25 years in prison.
